Welcome to EVIA ("we", "our", or "us"). These Terms of Service ("Terms") govern your use of our services and products.

Our Products and Services:

  • EVIA Insider - newsletter and educational content for POD entrepreneurs 

  • EVIA Design Library - commercial-use design assets for print-on-demand products

  • Educational resources and guides

  • Digital products and templates

By purchasing our products or using our services, you agree to these Terms. If you do not agree with these Terms, please do not use our services or purchase our products.

Acceptance of Terms

By accessing our websites, purchasing products, or subscribing to our services, you confirm that:

  • You are at least 18 years old

  • You have the legal capacity to enter into this agreementSurvey responses about your interests, preferences, and goals

  • You agree to comply with all terms and conditions outlined in this document

If you are under 18, you may not use our services or purchase our products.

If you are purchasing on behalf of a business, you confirm that you have the authority to bind that business to these Terms.

EVIA Design Library

When you purchase the EVIA Design Library, you receive:

  • 4,000+ base designs (clipart and seamless patterns)

  • Monthly design drops through June 2027 (200+ designs per month)

  • Full commercial Print-on-Demand (POD) license

All files you download are yours to keep. You may use them indefinitely, subject to the license terms.

Commercial License Terms

Your purchase includes a commercial POD license which grants you the right to: 

What You CAN Do:

  • Use designs on physical products for sale (mugs, t-shirts, tote bags, phone cases, etc.)

  • Sell products featuring our designs on any platform (Etsy, Amazon, Shopify, Printify, etc.)

  • Create unlimited products using our designs

  • Use designs in your Print-on-Demand business

  • Modify or customise designs for your products

What You CANNOT Do:

  • Resell, redistribute, or share the original design files in any format

  • Sell designs as digital downloads, printables, or templates

  • Upload designs to any platform where customers can download or access the digital file (including but not limited to Etsy digital downloads, Creative Market, Canva, Gumroad, etc.)

  • Share your account access or download links with others

  • Claim ownership or copyright over the original designs

  • Use designs to create competing design products or templates for resale

All designs in the EVIA Design Library remain the intellectual property of EVIA. When you purchase our products, you are granted a commercial license to use the designs as outlined above. You do not acquire ownership or copyright of the design files themselves.

License Violations

Violation of the license terms, including reselling or redistributing design files, may result in:

  • Immediate termination of your license

  • Legal action to recover damages

  • Other legal remedies as available under law

We take license compliance seriously to protect both our business and the legitimate customers who respect our terms.

If your license is terminated, you lose commercial rights and are not allowed to use the design templates for any new or existing work.

Payment Processing

All payments are processed securely through Sellfy. When you make a purchase, your payment information is collected and processed directly by Sellfy. We do not receive, access, or store your credit card or payment details.

By making a purchase, you agree to Sellfy's terms of service and privacy policy. All prices are in USD unless otherwise stated.

One-Time Payment

The EVIA Design Library is a one-time payment product. There are no recurring charges, subscriptions, or hidden fees. Pay once and keep all files indefinitely. Monthly drops through June 2027 are included at no additional cost.

Monthly design drops will conclude in June 2027. At that time, you may choose to renew for continued monthly drops but this is completely optional. All files you've received remain yours to keep and use, whether you renew or not.

Pricing Changes

We reserve the right to change product pricing at any time. Price changes apply only to future purchases. Customers who have already purchased from us will not be charged additional fees. 

We may offer promotional pricing or discounts at our discretion. Promotional prices may include specific terms or expiration dates.

Refund Policy

We offer a 30-day money-back guarantee. If you're not satisfied for any reason, contact us at [email protected] within 30 days of purchase for a full refund.

To request a refund, email us with your order number. While we always appreciate feedback on what didn’t work, as it helps us improve, detailed explanations are not required. Refunds are processed within 7 business days to your original payment method.

If you receive a refund, your commercial license to use the designs is immediately terminated. You must stop using all designs in any products, whether new or existing.

While you may retain the downloaded files, you no longer have commercial rights to use them. Continued commercial use after a refund constitutes a license violation and may result in legal action.

Once you've downloaded and used design files in your business, refund eligibility is at our discretion. We may deny refunds if files have been extensively used commercially before the refund request.

We reserve the right to deny refunds in cases of abuse, fraud, or license violations. Legitimate refund requests are always honoured.

Etsy Customer Upgrade Refunds

When you upgrade to the EVIA Design Library after purchasing from our Etsy shop, you are eligible for a refund of your Etsy purchase amount.

After purchasing the EVIA Design Library, contact us to claim your refund. Reply to your confirmation email with the following information:

  • Your Etsy order number(s) for all purchases from our Etsy shop

  • Your PayPal email address to receive your refund

Your total refund equals the sum of all verified Etsy purchases, capped at the Design Library price you paid. This offer is available to both early supporters and recent customers.

We will verify your Etsy purchase history, calculate your total eligible refund amount, and process the reimbursement to your PayPal account within 3 business days of verification.

This offer is available only for legitimate Etsy purchases. We reserve the right to verify purchase history and to deny refund requests that are incomplete, ineligible, or fraudulent.

File Delivery and Access

Design files are delivered via email immediately after purchase. You will receive Dropbox download links for the base library and monthly email notifications with links to each month's new design drop.

You are responsible for downloading and backing up your files, maintaining access to your email account, and storing files securely on your own devices.

While we strive to maintain permanent file availability, we cannot guarantee indefinite hosting of download links. You should download and backup all files promptly. We recommend storing files on multiple devices or cloud storage. 

If you lose access to your download links, contact us and we'll provide new ones after we verify your purchase.

Technical Support

We provide reasonable technical support for product-related issues, including download problems, file access issues, broken links, and file quality concerns.

We do not provide support for third-party software, print-on- demand platform setup, general business advice, or custom design services. For POD strategies and business guidance, please refer to the EVIA Insider newsletter.

EVIA Insider Newsletter

When you subscribe to EVIA Insider, you will receive weekly emails with POD strategies, tips, and resources. Your email address is collected and stored via Beehiiv.

You can unsubscribe at any time using the link in any email. Subscription is free and does not obligate you to purchase products.

Educational content provided through EVIA Insider is for your personal use and education. You may use the strategies and information in your own POD business.

You may NOT:

  • Resell or redistribute our educational content

  • Copy content verbatim for commercial use

  • Claim authorship of our content

  • Use content to create competing educational products

User Conduct and Prohibited Uses

You agree to use our products and services lawfully and in accordance with these Terms.

You may NOT:

  • Use our products for any illegal or fraudulent purpose

  • Violate any applicable laws or regulations

  • Infringe on intellectual property rights

  • Share account access or distribute files without authorization

  • Attempt unauthorised access to our systems or accounts

  • Abuse our services, refund policy, or engage in fraudulent activity

  • Violate the license terms outlined in this agreement

Violation of these terms may result in immediate termination of your account, loss of access to products, and potential legal action.

Intellectual Property

All content provided by EVIA including design files, templates, educational materials, website content, logos, branding, and graphics remains our exclusive property. You may not copy, reproduce, or distribute our content without permission.

When you share ideas or suggestions with us, you keep ownership of them. By providing feedback, you allow us to use your ideas to improve our products and services. We are not required to implement your suggestions or pay you for them. All feedback is voluntary and non-confidential.

Third Party Services

We use trusted third-party services to operate our business:

Beehiiv - Email and newsletter management

Sellfy - Payment processing and product delivery

Dropbox - File storage and delivery

Each of these services has its own terms and privacy policies. By using our services, you agree to their terms where applicable. We are not responsible for the actions, policies, or practices of these third-party providers.

Disclaimer of Warranties

Our products and services are provided "AS IS" and "AS AVAILABLE" without any warranties of any kind, either express or implied.

We do not guarantee that:

  • Our services will be uninterrupted or error-free

  • Design files will meet all your specific needs

  • Use of our products will result in business success or profits

  • All files will be free from defects or technical issues

While we strive for the highest quality, we cannot guarantee specific business outcomes from using our products.

Limitation of Liability

To the maximum extent permitted by law, we limit our liability as follows:

  • We are not liable for any indirect, incidental, or consequential damages

  • Our total liability is limited to the amount you paid for the product

  • We are not responsible for lost profits, business interruption, or data loss

  • We are not liable for third-party actions or service failures

This limitation applies even if we have been advised of the possibility of such damages. Some jurisdictions do not allow certain liability limitations, so some of these may not apply to you.

Account Termination

We reserve the right to terminate or suspend your access immediately if: 

  • You violate these Terms

  • You engage in fraudulent activity

  • You abuse or harass our team

  • We suspect unauthorised account usage

  • Required by law

Upon termination:

  • Your license to use our designs is revoked

  • You must stop using all EVIA designs in new products

  • You lose access to future monthly design drops

  • No refunds will be issued for violations

We take these violations seriously to protect our business and customers who respect our terms. Account termination is reserved for serious violations only.

Changes to Products or Services

We reserve the right to modify or discontinue products or services at any time, including product features, delivery methods, or monthly drop schedules.

We will honour the terms that were in effect at the time of your purchase. Significant changes will be communicated with reasonable notice when possible.

Modifications to Terms

We may update these Terms from time to time. When we make changes, we will update the "Last Revised" date at the top of this document. Significant changes will be communicated via email. 

Your continued use of our services after changes are made constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and EVIA regarding our products and services. They supersede any prior agreements or understandings.

Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms will be resolved in the courts of Victoria, Australia.
